Digital Millennium Copyright Act (DMCA)

It is the policy of Central Texas Multiple Listing Service, Inc. to respond to notices of alleged copyright infringement, in compliance with the Digital Millennium Copyright Act and other applicable laws.

To file a DMCA Notice with Central Texas Multiple Listing Service Inc., send a written letter by regular mail or email.  The written notice must include:

  1.  Identification of the copyrighted work.
  2.  Identification of the alleged infringing material.
  3.  Contact information of the person making the claim.
  4.  A statement that the claim is made in good faith.
  5.  A statement, made under penalty of perjury, that the claim is accurate and that the                  person is authorized to make it.
  6. A signature of the person making the claim.
  7. Notice must be sent to the DMCA designated agent:

If we receive a valid copyright claim, we will expeditiously remove or disable access to the alleged infringing material and notify the user that uploaded the material of the removal.  The alleged infringer may submit a counter-notice that Central Texas Multiple Listing Service Inc. must share with the copyright owner. The counter-notice must include:

  1.  Identification of the material that has been removed and location where it had appeared.
  2. A statement that the claim was made in good faith
  3. Contact information and signature of subscriber
  4. Counter-notice must be sent to the DMCA designated agent:

If the copyright owner fails to initiate a copyright lawsuit within ten (10) days, then Central Texas Multiple Listing Service, Inc. may restore the removed material.

Central Texas Multiple Listing Service, Inc. may discontinue service of repeat offenders.
